The petitioners seek regular bail in connection with Phulwarisharif P.S. Case No.781 of 2017 for the offences punishable under Section(s) 147, 148, 149, 427, 436 of Indian Penal Code.
The allegation in brief is that hundred unknown persons during the course of communal riot set fire in the poultry farm of the informant causing huge loss.
Learned Counsel for the petitioners submits that FIR is against unknown, about hundred in number, there is no material against the petitioners to connect them to the alleged occurrence and similarly situated other co-accused persons have also been
Patna High Court Cr.Misc. No.31757 of 2018 (2) dt.31-05-2018 2/2 granted bail by the coordinate Bench of this Court vide order dated 27.04.2018 passed in Cr. Misc. No.25646 of 2018. It is further submitted that the petitioners are said to be languishing in custody since 19.02.2018.
Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna in connection with Phulwarisharif P.S.
