JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2016 The present modification application has been filed for modification of the order dated 09.07.2015 passed in Cr. Misc. No. 21345 of 2015.

It was submitted on behalf of the petitioner that the petitioner is ready to deposit 20% of the outstanding due of Rs. 52,01,439/-. Considering the said fact the petitioner was granted provisional bail for depositing twenty percent of the said amount within a period of nine months but the petitioner had failed to do so. Hence, the present modification application was filed for extending the period, so that he could deposit the amount in question.

A supplementary affidavit has been filed on behalf of

Patna High Court Cr.Misc. No.16513 of 2016 (6) dt.23-11-2016 2/2 the petitioner in course of argument. In para-7 of the said supplementary affidavit, it has been stated that the petitioner, in compliance to the aforesaid order he had already deposited a sum of Rs. 10, 43, 000/-. The said fact is not controverted by the counsel appearing on behalf of the Bihar State Food and Civil Supplies Corporation Limited.

Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner is confirmed and the order dated 09.07.2015 passed in Cr. Misc. No. 21345 of 2015 is modified to the extent as indicated above.

The modification application is, accordingly, disposed of.
