JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-08-2020 Heard learned counsel for the petitioner and Mr. Anand Kishore Choudhary, learned APP for the State. Petitioner in the present case is seeking regular bail in connection with Rajepur P.S. Case No.99 of 2019 registered for the offence under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there are general and omnibus allegations against the petitioner. The petitioner is in jail since 07.11.2019 and has got no criminal antecedent.

Learned APP for the State is present and has opposed the prayer for regular bail of the petitioner as according to him there are enough materials to show that this petitioner had assaulted the deceased causing severe injuries on her vital part

Having regard to the facts and circumstances of the case and on perusal of the case diary, this Court has noticed that the witnesses in paragraphs 38, 39, 40 and 41 have specifically alleged against this petitioner causing assault on the deceased and the postmortem report also suggest injuries on vital part of the body such as chest of the deceased. Considering that the witnesses have come out specifically and whole allegations of assault against this petitioner, in the nature of the seriousness of the offence, I am not inclined to grant regular bail to the petitioner. The prayer is refused.

Let the trial be expedited.
