The petitioners apprehend their arrest in connection with Bakhtiyarpur (Balwahat O.P) P.S. Case no. 26 of 2018, registered under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.
The accusation is that on 19.01.2018 at about 1.30 P.M. informant Murlidhar Singh along with Ashok Yadav were returning from field. In the way, six persons named in the F.I.R., including the petitioners, surrounded and abused them saying that as to why Rs. Five Lakhs has not been given by them, when the informant made protest then Arun Yadav gave Farsa blow at the head of informant, when Ashok Yadav rushed to save him then Satish Yadav and Arbind Yadav caused injury
Patna High Court Cr.Misc. No.31349 of 2018(2) dt.12-06-2018 2/2 through Dabiya at his left finger and another persons also caused injury through lathi. On raising alarm, villagers rushed there at that time they also snatched golden chain and Rs. 2000/- from the pocket of the informant. The cause of occurrence is of land dispute.
Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but specific allegation to cause injury to the informant is against Arun Yadav further allegation is against Satish Yadav and Arbind Yadav to cause injury to Ashok Yadav. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Balwahat O.P) P.S. Case No. 26 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
