JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Piprahi P.S. Case No. 206 of 2019 for offences under Sections 323, 342, 354, 354A, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The allegation against the petitioner is that when Sushma Kumari was returning from Coaching Institute, Sheohar, this petitioner caught hold of her bicycle and threatened her to compromise the previous case. There is further allegation against the petitioner that on WhatsApp he informed her that he will solemnize marriage with the informant. The case was instituted on 26.11.2019 after gap of

Patna High Court CR. MISC. No.14247 of 2020(2) dt.06-07-2020 2/2 two and half months as the alleged occurrence took place on 02.09.2019.

Considering the fact that there is delay of more than two and half months in lodging the first information report and there is no overt act of outraging the modesty of the informant against the petitioner, this Court is inclined to grant bail him. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sheohar in connection with Piprahi P.S. Case No. 206 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to further condition that bailors should be parents of the petitioner.
