Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

It is alleged that informant gave Rs. 76,000/- to the petitioner on 02.04.2011 for cultivating 27 decimals of land, but the petitioner sold the said land to someone and subsequently threatened to the informant.

It is submitted by learned counsel for the petitioner that the land was sold on 14.01.2011. Hence there was no question of receiving money on 02.04.2011. Moreover, there is no document to the effect that petitioner received any money from the informant.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.15745 of 2015 (2) dt.04-05-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(Industrial) P.S. Case No. 4 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
