The petitioner apprehends his arrest in Alauli P.S. Case No. 164/2015, registered for the offences punishable under Section 409 and 420 of the Indian Penal Code. The petitioner being the Head Master of the school withdrew huge amount for construction of school building, but he did not get building constructed in spite of many reminders. He withdrew the entire money in the year 2010-11. It is submitted that the District Programme Officer vide letter at annexure 2 informed the Station House Officer, Alauli that for the last ten days the petitioner has started constructing the school building, but from perusal of the record, it appears that the petitioner withdrew the entire money for construction of the

Patna High Court Cr.Misc. No.16357 of 2016 (2) dt.09-05-2016 2/2 school in the year 2010-11 and he kept the entire money with him without getting the building constructed.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
