Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has been visited with a penal order dated 17-03-2023, as contained in Annexure- 3 to the supplementary affidavit, inflicting the punishment of withholding of one increment forever. The other consequence is deprivation of any emoluments other than subsistence allowance for the period of suspension.

Learned counsel for the petitioner submits that the

Patna High Court CWJC No.4236 of 2023(3) dt.22-09-2023 2/2 petitioner would assail the order of punishment before the Appellate Authority.

Since the order has been passed during pendency of the instant writ proceedings, the issue of delay is required to be considered having regard to pendency of these proceedings, in case the petitioner's avail the remedy of appeal within three weeks.

Accordingly, writ petition is disposed of.
