====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-09-2021 This matter is taken up for consideration through Video Conferencing.

Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in a case registered for the offence punishable under sections 302, 201 and 120B/34 of the Indian Penal Code.

As per prosecution case, this petitioner along with others had taken the husband of the informant but after some time, victim had become traceless. It is suspected that this petitioner and others had committed murder of the deceased.

Submission of learned counsel for the petitioner is that informant is not an eye witness of the occurrence and only suspicion has been raised against all the accused persons. During course of investigation, it has come in para 80 and 81 of the case diary that one Firo Kewat who was clerk of this petitioner was removed by him and

Patna High Court CR. MISC. No.26338 of 2021(3) dt.13-09-2021 2/2 deceased was kept as clerk. As a result in retaliation, Firo Kewat committed murder of the deceased. Petitioner is in custody since 13.01.2021. Investigation is complete.

Learned counsel for the State opposes the prayer for bail. Considering the facts and circumstances of the case, this bail application is allowed. Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Nalanda at Biharsharif in Noorsarai P.S. Case no. 06/2012 on the following conditions.

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be canceled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
