JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2015 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 323m 379m 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that during pendency of the present application, an application has been filed before learned Court below to the effect that both sides have compromised the issue. A photocopy of the certified copy of the said compromise petition has been filed. Let it be kept on record. It is further submitted that informant, at present is residing with the petitioner. Patna High Court Cr.Misc. No.21879 of 2015 (2) dt.23-06-2015 2/2 the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara in connection with Bhojpur Mahila P.S. Case No. 34 of 2015. The provisional anticipatory bail of the petitioner will be confirmed by the learned Court below on verification of the fact that compromise petition has been filed before learned Court below.
