The petitioners apprehend their arrest in Lalganj P.S. Case No. 160 of 2017 registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioners dashed the cycle of the informant by the motorcycle in which the informant got injuries. When the informant came to his house after treatment, Kant Lal Mahto, the elder brother of the informant, went to complain the petitioners are alleged to have assaulted the mother and the brother of the informant.

Learned counsel for the petitioners submits that some altercation took place in which both sides entered into free fight.

Patna High Court Cr.Misc. No.46477 of 2017 (2) dt.22-09-2017 There is a counter version. Patasiya Devi, the mother of the informant, got one lacerated wound and two bruise which are simple in nature.

Considering the facts aforesaid and the fact that both the sides entered into free fight and the injuries found on the person of the mother of the informant are simple in nature, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Lalganj P.S. Case No. 160 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
