Petitioner seeks bail in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.
The FIR of the occurrence of theft is against unknown. The learned court below has refused the prayer for bail of the petitioner considering submission of the State that the sale proceeds of the stolen property was recovered from possession of the petitioner.
Considering the very weak evidence against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.29071 of 2018 (2) dt.14-05-2018 satisfaction of learned Court below where the case is pending in connection with Chanpatiya (Sirisiya O.P.) Police Station Case No.34 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
