Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Valmikinagar P.S. Case No. 10 of 2021 registered for the offences punishable under Sections 420/406/504/34 of the Indian Penal Code and Section 138 of N.I. Act and also Section 3/4 of the Dowry Prohibition Act.

The marriage was never solemnized. There is dispute with regard to money given before marriage.

The petitioner alleges that the entire amount of Rs. 4.5

Patna High Court CR. MISC. No.15774 of 2022(2) dt.19-05-2022 2/2 lakhs has already been given to the informant's side whereas the informant alleges that the money is still not given to them. All these disputes cannot be decided in the present proceeding.

Considering the facts and circumstances of the case and also considering the nature of dispute, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bagaha, West Champaran, in connection with Valmikinagar P.S. Case No. 10 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
