JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-05-2016 Petitioner being brother-in-law of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B, 324, 326, 307, 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of killing the niece of the informant after three years of marriage by causing burn injury.

It is submitted by learned counsel for the petitioner that petitioner is brother-in-law of the husband of the victim and resides at different place. The accusation is omnibus and general against the entire in-laws family including the petitioner. The thrust of accusation is against the husband of the victim and the victim received accidental injury while cooking. Moreover the informant has retracted from the

Patna High Court Cr.Misc. No.17016 of 2016 (3) dt.10-05-2016 2/2 initial version and has filed a petition to that effect before learned Court below.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 596 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
