The petitioner seeks bail in connection with Barun P.S. Case No. 260 of 2019, registered under Sections 302/34 of the Indian Penal Code.

The accusation is that informant Manju Devi along with her husband Bhuneshwar Paswan and children, after taking dinner, slept in the house of her father, in the night, she woke up on hearing the cry of children then saw her husband had sustained knife injury in his belly, then she came out from the house and saw two persons were moving from there, but she could not identify them. Thereafter, her husband was rushed to the hospital, but he died in course of treatment. Learned counsel for the petitioner submits that on

Patna High Court CR. MISC. No.13846 of 2020(2) dt.03-03-2020 2/2 the basis of fardbeyan of informant, Barun P.S. Case No. 260 of 2019 was instituted under section 302/34 of the Indian Penal Code against unknown. In course of investigation, suspicion was raised against co-accused Jay Kumar, who used to visit at the house of father of the informant, and, thereafter, he was apprehended and his confessional statement was recorded in which he disclosed the name of petitioner, except, the confessional statement no tangible evidence collected by the I.O against the petitioner. The petitioner has no criminal antecedent and he is in custody since 09.12.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 260 of 2019.
