The petitioners, four in number, apprehend their arrest in Chainpur P.S. Case No. 58 of 2016 registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code. Indrajit Yadav is alleged to have assaulted Santoshi Devi, the informant. Thereafter, the petitioners are alleged to have assaulted Santoshi Devi, Amar Yadav, Hanuman Yadav and Subhash Yadav. There is no injury report of Santoshi Devi and Hanuman Yadav. Subhash Yadav got simple injuries. Amar Yadav also got simple injuries but one injury on his hand is opined to be grievous on account of fracture. It is submitted that there is a counter-version and, from the side of the petitioners also, four

Patna High Court Cr.Misc. No.17243 of 2016 (3) dt.15-07-2016 2/2 persons are injured. There is no specific allegation as to who assaulted Amar Yadav causing fracture injury in his hand. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Chainpur P.S. Case No. 58/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
