Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Siswan P.S. Case No.65 of 2016 registered for the offences punishable under Sections 25(1-A), (1-B), 26 and 35 of the Arms Act and Sections 3/4/5 of the Explosive Substances Act. On secret information, the police party reached at the place of occurrence. This petitioner and other co-accused on seeing police party started indiscriminate firing on them. Three miscreants were apprehended by police party after some chase and from possession of this petitioner one regular carbine 9 mm with ten live cartridges, one hand grenade, one magazine with 20
Patna High Court Cr.Misc. No.31312 of 2018 (3) dt.10-07-2018 live cartridges, one fighter and one pen drive were recovered. Some arms and ammunitions were also recovered from other coaccused. This petitioner has 61 more cases with similar allegation.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case as well as recovery of firearms from possession of this petitioner, I am not inclined to enlarge the petitioner on bail. Prayer of bail is accordingly rejected.
