The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 325, 354 and 448/34 of the Indian Penal Code. As alleged, it is a case of assault by means of lathi and danda wherein informant got her hand fractured and further an attempt of outraging the modesty of the informant/victim was made by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is a Bhaisur of the informant and there is land dispute between the parties, due to which, this case was lodged by the informant. Petitioner is an old person, aged

Patna High Court CR. MISC. No.15368 of 2022(2) dt.12-09-2022 2/2 about 60 years. He further submits that there is no intention to insult the informant and outrage the modesty of the informant. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Mahua P.S. Case No. 740 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
