1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 365, 307, 384, 379, 324, 504 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. It is further submitted that a similarly situated co-accused has been granted the privilege of anticipatory bail by a learned Co-ordinate Bench by an order dated 12.03.2024 in Criminal Miscellaneous No. 15047 of 2024 (Pawan Kumar Vs. The State of Bihar). It is further submitted that the case of the petitioner is akin to the case of Pawan Kumar. It is also submitted that petitioner and the informant are co-villagers and as such it does not appear probable that the accused persons including the petitioner would

No.17477 of 2024(3) dt.28-03-2024 2/2 have forcefully taken the informant along with them and would have assaulted for the purposes of extortion and thereafter would have left him, as the informant and the petitioner are known to each other. It is thus submitted that for some ulterior reason, the present false case came to be implicated.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jagdishpur P.S. Case No. 263 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
