JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2022 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. In compliance of the Order dated 03.11.2022, the informant along with the petitioners are physically present in the Court.
Learned counsel for the informant at the outset based on instructions from the informant submits that informant has given instructions that she does not intend to pursue the case against the petitioners but she will pursue her case against her
Patna High Court CR. MISC. No.18604 of 2019(4) dt.01-12-2022 2/2 husband only and other accused persons who are not petitioners before this Court in the present application. Learned counsel for the informant further submits that informant does not have any issue if the present quashing application is allowed and the order taking cognizance is quashed.
Learned counsel for the petitioners submits that a fair stand has been taken by the complainant and efforts would also be made to ensure that some settlement between the complainant and her husband is arrived at.
Considering the submissions made by the learned counsel for the informant based on instructions the order dated 17.01.2019 passed in Complaint Case bearing No. CR No. 301 of 2016 instituted under Section 498A, 323, 380 and 504 I.P.C read with Section 3 & 4 of the Dowry Prohibition Act in which cognizance has been taken under Section 498A of the I.P.C. by the learned S.D.J.M, Benipatti, Madhubani is hereby quashed.
