This is an application for bail in connection with Town P.S. Case No. 174 of 2017 registered for the offences punishable under Section 414 of the Indian Penal Code.

Allegation as per FIR is that police has apprehended one person with a motorcycle and he disclosed the name of petitioner as owner of the motorcycle and he has gone for making the key and at his instance house of the petitioner was raided and three motorcycles were recovered from the rented house of the petitioner.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated in this case and he is in custody since 1.7.2017

Patna High Court Cr.Misc. No.46550 of 2017 (2) dt.20-09-2017 2/2 having no criminal antecedent.

Heard learned APP also.

Having heard both sides and in view of facts and circumstances, this application is disposed of with a direction to the court below that once charge has been framed in this case or petitioner completes six months period in judicial custody, whichever is earlier, the petitioner will be released on bail to its own satisfaction, if an application is filed on behalf of petitioner for bail.
