2. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 504, 338, 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged against the petitioners that they shot at the informant, as a result of which, the informant sustained gunshot injuries on his knee.

4. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners and informant are

Patna High Court CR. MISC. No.19285 of 2024(2) dt.02-04-2024 2/2 agnates and in the background of some previous dispute, the present accusation has been levelled against the petitioners. There is counter version of the occurrence also and petitioners' side also sustained injuries. The injury of the injured informant is in the knee which is not the vital part of the body. The petitioner No. 1 has surrendered voluntarily on 05.01.2024 whereas the petitioner No. 2 surrendered on 10.01.2024.

5. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi in connection with Dhanaura P.S. Case No. 457 of 2023.
