The petitioner seeks bail in Paliganj P. S. Case No. 08 of 2017 instituted for the offence under Section(s) 341, 323, 307,34 of the Indian Penal Code. Later on, Section 302 of the I.P.C. was added.
Earlier, the prayer for bail of the petitioner was rejected by co-ordinate Bench of this Court vide order dated 2.2.2018 passed in Cr. Misc. no. 55567 of 2017 with liberty to renew prayer for bail after one year if the trial is not concluded. In the written report, it is alleged that this petitioner gave hammer blow on head of father of informant who succumbed to the injuries during treatment.
Patna High Court CR. MISC. No.14460 of 2019(3) dt.28-05-2019 2/2 A report regarding present stage of case was called for which has been received. From perusal of the report, it appears that all the private witnesses have been examined in this case. The doctor is only required to be examined.
Learned counsel for informant submits that examination of doctor has also now been completed. The trial Court has mentioned in the report that trial is likely to be completed within a period of two months.
In such circumstances, since trial has progressed and all the prosecution witnesses have been examined, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected. Trial Court is directed to conclude the trial positively within a period of three months from the date of receipt of copy of this order and send compliance report.
Petitioner will be at liberty to renew prayer for bail if the trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U T
