1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Pauthu Police Station Case No. 32 of 2022, dated 20.04.2022, disclosing offences under Sections 302/201/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 19.04.2022, the informant's son, namely, Benkatesh (now deceased), received a call and upon asking, informant's son told that co-accused Lakhandev Sharma @ Santosh Sharma and Bali Sharma @ Ashutosh Sharma had called to pay him wages. After saying this, the informant's son went to Pauthu and did not return in the night. On 20.04.2022, after search, the informant
Patna High Court CR. MISC. No.15541 of 2025(5) dt.06-08-2025 2/3 found the dead body of her son lying on the road near Khadeshwar Temple. The informant raises suspicion that his son has been killed by co-accused Lakhandev Sharma, Bali Sharma and the petitioner.
4. Learned counsel for the petitioner submits that the petitioner has been made accused on the basis of suspicion only. He next submits that in the First Information Report it has been clearly stated that coaccused Lakhandev Sharma and Bali Sharma called the deceased for paying wages. The petitioner is in custody since 21.04.2022 i.e. about 03 years 03 months. He next submits that co-accused Lakhandev Sharma and Bali Sharma have been granted regular bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 37958 of 2022, dated 24.04.2023.

Regards being had to the submissions made by the parties and taking into consideration the nature of allegation and the fact that the petitioner is in custody for more than three years and similarly situated co-accused persons have been granted regular bail by a Co-ordinate Bench of this Court, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned District and Sessions Judge VIII, Aurangabad, in connection to the Pauthu Police Station Case No. 32 of 2022.
8. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
