Petitioner seeks bail in a case registered for the offences punishable under Sections 385/387 of the Indian Penal Code.
It appears that earlier prayer for bail was refused on 24.04.2017 in Cr.Misc.No.5518 of 2017 vide Annexure-1 with liberty to renew the prayer, if the trial is not concluded within nine months.
The impugned order would reveal that the trial is at the stage of prosecution evidence. Petitioner is in custody since 04.06.2016.
Allegation against the petitioner is that he
Patna High Court Cr.Misc. No.29967 of 2018 (3) dt.18-07-2018 2/2 demanded ransom from the informant and on failure of the same he threatened the informant and his son to kill them. Referred mobile is of the petitioner and in paragraph 24 of the case diary the police has recorded, on the basis of call details, that several times phone was called from the mobile of the petitioner.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Imadpur Police Station Case No.21 of 2016, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
