The petitioner seeks bail in anticipation of his arrest in connection with Matihani P. S. Case No. 156 of 2017 dated 22.09.2017 instituted for the offences under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is alleged to have resorted to several rounds of firing at the informant but curiously, the informant has not received any injury.
The reasons for false implication, it has been argued, is not far to seek. The petitioner and others had deposed against one Arvind Singh in Sessions Trial No. 668 of 2008 and since the informant of the present case is the
Patna High Court CR. MISC. No.15143 of 2019(2) dt.13-03-2019 2/2 sympathizer of Arvind Singh and other accused persons of Sessions Trial No. 668 of 2018, the present case has been instituted against the petitioner and others at the instance of the accused persons of Sessions Trial No. 668 of 2018. Regard being had to the aforesaid facts as also taking into account that the petitioner does not have any criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Junel Alam, J.M. 1st Class, Begusarai in connection with Matihani P. S. Case No. 156 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
