JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-05-2022 Heard Mr. Sanjiv Kumar Singh, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kharagpur P.S. Case No. 446 of 2019 dated 25.12.2019 instituted for the offences under Sections 414 and 34 of the Indian Penal Code.
A truck loaded with iron rod was pilfered. During the course of investigation, one Sanjay Kumar Verma was arrested, who has confessed the participation of the petitioner also in the offence. Apart from the aforesaid confession of Sanjay Kumar Verma, a co-accused, there is no other material to connect the petitioner with the offence.
The petitioner does not have criminal record. Considering the nature of accusation against the

No.25324 of 2021(2) dt.25-05-2022 2/2 petitioner and taking into account that nothing has been recovered from him or his constructive possession, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Munger in connection with Kharagpur P.S. Case No. 446 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
