JUSTICE SANJAY KUMAR ORAL ORDER 02-07-2018 Heard leaned counsel for the petitioner as well as the learned APP for the State.

The petitioner is in custody in connection with K.Hat P. S.Case No.80 of 2018 registered for an offence under Sections 341, 386, 307 and 506/34 of the IPC and section 27 of the Arms Act.

As per FIR one Bittu Singh is named in the FIR along with one unknown who visited at the shop premises of the informant and demanded Rs.2,00000/-. In course of altercation, the informant snapped photo of accused whereafter the miscreants took out pistol from their waist and shot fire causing damage to his premises.

It has been submitted that the said two accused were put on test identification parade by the SHO and both of them were identified by the informant. The name of this petitioner appeared

Patna High Court Cr.Misc. No.29729 of 2018 (3) dt.02-07-2018 2/2 on the confessional statement of co-accused Suman Kumar Singh and Niraj Kumar Jha. The father of the petitioner had complained against the police officer whereafter the petitioner has been booked in some other cases. The petitioner is in custody since 15.03.2018.

The learned APP opposed the submission.

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Purnea in connection with K.Hat P.S.Case No.80 of 2018 with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
