Petitioner, already in custody, seeks bail in connection with Hajipur Sadar P.S. Case No.54 of 2014 registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the informant's brother was called by the petitioner and went away and thereafter he was killed and suspicion is raised that the petitioner killed the brother of the informant due to dispute relating to money. Learned counsel for the petitioner submits that only suspicion was raised against the petitioner and one of the accused Vikash Kumar was granted bail by a co-ordinate Bench of this Court vide order dated 09.02.2016 passed in Cr. Misc.

Patna High Court Cr.Misc. No.31736 of 2018(3) dt.29-06-2018 2/2 No.51394 of 2015; whereas the learned counsel for the State submits that the petitioner had called the deceased and thereafter he was killed by firearm. He further submits that this petitioner was absconding for last four years and he is in custody only for last three months.

Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected.
