The petitioners are in custody in connection with Ara Nawada P.S. Case No. 385 of 2017 registered for the offences under Sections 420 and 34 of the IPC.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. Referring to the statements made in para-6 of the bail application, counsel submits that due to mistake Rs. 3,20,000/- was transferred in the Account of Petitioner No. 2. However, the petitioners have returned the said amount to the informant and the informant has filed affidavit to that effect.

Considering the fact that the petitioner No. 2 has

No.32831 of 2018(2) dt.04-06-2018 2/2 transferred the amount of Rs. 3,20,000/- in favour of the informant as is evident from the affidavit of the informant, contained in Annexure-2 and also considering the fact that the petitioners have no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 385 of 2017.
