06-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Sachiwalaya Mahila P.S. Case No. 19 of 2020 registered for the offence under Sections 376 and 420 of the Indian Penal Code. In the F.I.R., the informant, who is aged about 25 years on the promise of marriage by the petitioner, established physical relation with the petitioner and thereafter, the petitioner refused to solemnize marriage with the informant. It is further alleged in the F.I.R. that petitioner also took Rs. 1,50,000/- from the informant in the name of business.

It is submitted on behalf of petitioner that petitioner in innocent and has committed no offence. In the F.I.R., the informant herself admits that physical relation established with the consent of the parties. It is further submitted that in order to

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Sachiwalaya (Mahila) P.S. Case No. 19 of 2020, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
