JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-03-2023 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of the appropriate writ / writs, order/ orders, direction directions in the nature of certiorari for quashing the letter no.178 dt. 21.4.2015 issued by the respondent no.4 (The Executive Engineer, Bihar State Housing Board, Laheriasarai, Darbhanga) from the name of husband of the petitioner whereby and whereunder the petitioner husband has been directed to vacate the house no.M.H-48 till

Patna High Court CWJC No.7359 of 2015(2) dt.28-03-2023 2/2 23.04.2015 which has been illegally occupied; (ii) For issuance of an appropriate writ / writs, order/orders, direction / directions to the respondents Bihar State Housing Board to make allotment of House no. M.H-48 situated Bihar State Housing Board colony, Laheriasarai, Darbhanga from the name of petitioner's mother namely Bhawani Devi after taking the consideration money fixed by the Bihar State Housing board;

(iii) To direct the respondents to not take any coercive action against the petitioner as per the letter no. 178 dt. 21.4.2015. "

At the outset, the learned counsel for the petitioner submits that since the petitioner has already been evicted from the premises in question, the present writ petition has been rendered infructuous, however, liberty be granted to the petitioner to pursue his remedies qua the subsisting grievances. Liberty so sought is granted.

The writ petition stands disposed off.
