Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498(A)/34 of the Indian Penal Code. The basic accusation is of torture.

A supplementary affidavit has been filed bringing on record Annexure-2 to the effect that informant has filed a petition before learned Court below to the effect that both sides have decided to part ways.

Learned counsel for the informant though admits that supplementary affidavit has been served to him by learned counsel appearing on behalf of the petitioner but he has no instruction in this regard.

Considering the present stand of the parties,

Patna High Court Cr.Misc. No.22361 of 2015 (2) dt.08-07-2015 2/2 let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nalanda at Biharsharif in connection with Noorsarao P.S. Case No. 298 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The bail bonds of the petitioner will be accepted on verification of the submission of the compromise petition by the informant before learned Court below. (Dinesh Kumar Singh, J) Shageer/- U T
