JUSTICE ARUN KUMAR ORAL ORDER 10-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.3.2018, seeks bail in Kesariya PS Case No. 50 of 2017 registered under Sections 406, 420, 504 and 506/34 of the IPC.

The allegation in brief is that for the financial year 2014-15 the informant and all accused persons formed a group for allotment of foreign liquor shops under the government scheme, participated in the lottery, one shop was allotted and license was given in the name of Vivek Kumar, elder brother of the petitioner, the petitioner was looking after the shop as a Manager, it is alleged that investment was made by the informant and others also but they are not giving any statement of accounts and have defalcated altogether approximately 73,94,000/- rupees.

Learned Counsel for the petitioner submits that the license was in the name of his elder brother, as per the allegation itself he was only looking after the shop as a Manager, it is a dispute of accounts, similarly situated another co-accused, father of the petitioner, has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 22079 of 2018 and the petitioner has no criminal antecedent.

No.29248 of 2018 (2) dt.10-05-2018 Having considered the said facts and circumstances, the petitioner, namely, Abhinav Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XI, East Champaran, Motihari in connection with Kesariya PS Case No. 50 of 2017.
