The petitioner apprehends his arrest in connection with Amnaur P.S. Case No.345 of 2020, registered for the offence punishable under Section 379 of the Indian Penal Code. The petitioner is said to have stolen the poclain machine seized by the police officials.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is business dispute between the parties. It is submitted that no incriminating article has been recovered from the conscious possession of the petitioner. It is further submitted that there is no eye witness of the occurrence.

Taking into consideration the facts and circumstances of the case, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-9th, Saran at Chapra in connection with Amnaur P.S. Case No.345 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
