JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 691 of 2018, disclosing offences under Sections 341, 323, 379/34 of the Indian Penal Code and later on added Sections 307 and 302 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is that they entered inside the house of the informant and assaulted the husband of the informant and later on husband of the informant died.

Heard both sides.

Heard learned APP for the State, who has submitted that process under Sections 82 and 83 has already been exhausted, which appears from para 116 of the case diary.

No.14467 of 2019(3) dt.01-05-2019 2/2 Having heard both sides, in view of the facts and circumstances as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
