The petitioner apprehends his arrest in connection with Complaint Case No. 4083 of 2014 in which, cognizance has been taken for the offence under Sections376/511 of the Indian Penal Code. The petitioner happens to be elder brother-inlaw of the complainant and the accusation against him is that he made attempt to commit rape on the complainant at about 6.00 a.m. on 16-12-2014. The complaint case was filed on 18-12-2014 and prior to the aforesaid complaint case, fardbeyan of the petitioner was recorded on 17-122014 in hospital by the police and in the aforesaid
Patna High Court Cr.Misc. No.22914 of 2015 (2) dt.09-07-2015 2/2 fardbeyan, the petitioner specifically, stated that he was mercilessly, assaulted by the husband of the complainant and others and in the aforesaid occurrence, his wrist was found broken.
Learned counsel, appearing for the complainant submits that in course of supervision of Bidupur P.S. Case No. 425 of 2014, the police found that the petitioner had greedy eyes on the complainant as a result of which, the occurrence of Bidupur P.S. Case No. 425 of 2014 took place.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 4083 of 2014 to the satisfaction of Sri Ravi Kumar, Judicial Magistrate-Ist Class, Vaishali at Hajipur.
