====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, seeks bail in connection with Keoti P.S. Case No. 120/2019 as well as G.O. Case No. 835/19, dated 21.08.2019, instituted for the offence under Section 30(a), 38(1) of Bihar Prohibition and Excise Act, 2016.

The petitioner is stated to be in custody since 23.01.2020.

The petitioner and about thirteen other persons are said to have been manufacturing country made liquor. They all escaped from the place when raid was conducted.

Learned counsel for the petitioner questions the intelligence of the police officer in as much as the sources of name of the petitioner and others who are

115 litres of liquor is said to have been recovered from the place which was raided.

The petitioner earlier was made accused in a case of similar nature but he is on bail in the aforesaid case. The implication of the petitioner, it has been urged, is only because of his having been made accused in the past in a similar nature of case.

Regard being had to the nature of accusation and period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Excise Act, Darbhanga In connection with Keoti P.S. Case No. 120/19 as well as G.O. Case No. 835/19.

The application stands allowed.
