The petitioner apprehends his arrest in Patory (Mohanpur OP) P.S. Case No. 475 of 2021, registered for the offences punishable under Sections 341, 323, 427, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the FIR, petitioner along with other co-accused persons surrounded, threatened and assaulted the informant and one Hira Kumar with fist and slaps and butt of pistol. The accused persons also opened fire.
It is submitted that allegation is general and omnibus and due to political rivalry petitioner has been made accused in this case. There is no specific overt act has been alleged against this petitioner. None has sustained any injury or firearm injury.
