Sahin Begam ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.12.2017, seeks bail in Sakara PS Case No. 497 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-B)a, 26, 35, 25(1-AA) and 25(1-AAA) of the Arms Act.

The allegation in brief is that the police apprehended several persons from the orchard of the village and recovered arms from the possession of some of the accused but nothing was recovered from the possession of the petitioner and Shatrughan Sahni. Learned Counsel for the petitioner submits that the petitioner was falsely implicated, nothing has been recovered from his possession, merely on suspicion he has been apprehended by the police, prior to institution of the present case he had no criminal antecedent and only subsequently he has been remanded in two other cases.

Having considered the said facts and circumstances, the petitioner, namely, Nanki Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Muzaffarpur in connection with Sakara PS Case No. 497 of 2017.

Patna High Court Cr.Misc. No.29244 of 2018 (2) dt.10-05-2018 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
