The petitioner apprehends his arrest in Sangrampur P.S. Case No. 45 of 2009, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner is alleged to have assaulted Lakhrajo Kuwar with knife on her head and corresponding injury is found. The doctor has opined the injury to be dangerous to life. It is submitted that the police after investigation submitted final form against the petitioner, but the learned court below took cognizance.

Considering the facts aforesaid and the fact that there is very specific allegation that it was he who assaulted Lakhrajo Kuwar with knife and the injuries incised was found on the vital
