JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Dulhin Bazar P.S. Case No.204 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152 and 504 of the Indian Penal Code.
The prosecution case, in brief, started on the basis of self written statement of S.I. Akhilesh Kumar S.H.O. of Dulhin Bazar Police Station, recorded himself on 18.12.2015 at about 21.00 hours at Sadabah chouk, Dulhin Bazar, alleging that on 18.12.2015 at about 18.40 hours informant got an information upon his Mobile phone
Patna High Court Cr.Misc. No.15795 of 2016 (2) dt.16-05-2016 2/3 that one person has been dashed by a truck, upon such after entry station diary Sanha, informant informed his higher officials regarding the occurrence and rushed to the place of occurrence along with the police forces at 6.45 P.M. on 18.12.2015, and reached at Dulhin Bazar Sadabah Chouk at 6.50 P.M. and found that one person was lying dead at Dulhin Bazar, Sadabah Chouk and his head was found crushed due to accident.
It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. No specific allegation has been made. Injury is simple in nature. Other co-accused have been granted bail vide Cr. Misc. Nos.18396 of 2016, 16164 of 2016 and 18999 of 2016.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of
