Heard learned counsel for the petitioners and learned A.P.P. for the State along with learned counsel appearing on behalf of the informant.

The learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner Nos. 1 (Amit Kumar @ Ramlal), 2 (Ramanand Khan), 3(Bipin Kumar @ Vinit Kumar) and 5(Chandra Bhushan Sharma).

Permission is accorded.

The petitioner no. 4 apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code. 5.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the instant case. It is also submitted that specific allegation of assault is against Amit Kumar, and as far as the petitioner is concerned, the allegation against him is general and omnibus in nature.

The learned APP along with the learned counsel appearing on behalf of the informant opposes the anticipatory bail application, but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that the allegation against the petitioner is general and omnibus in nature.

Considering the submissions made by the learned counsel for the petitioners, the petitioner no. 4, (Sumit Kumar), in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case

Patna High Court CR. MISC. No.19009 of 2024(2) dt.10-04-2024 3/3 is pending/successor court in connection with Chakmehsi P.S. Case No. 155 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
