JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsels for the petitioner, informant and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Morkahi P.S. Case No. 02/2015, G.R. No. 48/2015 for the offences instituted under Sections 323, 341, 504, 506 and 498(A)/34 of the IPC.
The prosecution story, in brief, is that the marriage of the informant took place ten years ago and out of wedlock she gave birth to three children. Further it has been alleged that on the instant of the petitioner her in-laws members kept her confined in the house and with intention to kill they were trying to administer
Patna High Court Cr.Misc. No.21714 of 2015 (3) dt.04-09-2015 2/2 poison and on refusal they assaulted the informant. On alarm raised by the informant the persons nearby saved her life. It has been submitted by learned counsels for the petitioner and the opposite party no. 2 that they are agree to reside together.
Considering the said fact, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Morkahi P.S. Case No. 02/2015, G.R. No. 48/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
