This is an application seeking quashing of F.I.R. bearing Patrakar Nagar P. S. Case No. 272 of 2011 dated 02.12.2011, instituted for the offences under Sections 498(A), 323, 341, 504 and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.20523 of 2016(4) dt.20-01-2021 2/2 Mr. Rakesh Kumar Sharma, learned Advocate for Opposite Party No. 2 has informed this Court that even though charge-sheet has been submitted in this case but there has been a settlement of dispute between the spouses.

In that view of the matter, this Court though is not inclined to quash the F.I.R. as charge-sheet has already been submitted but directs that the factum of the settlement of dispute would be brought before the notice of the court below who shall pass orders in accordance with law. In case any order is passed which is not to the satisfaction of the parties, it would be open for them to avail the remedies to which they are entitled.
