This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by order dated 17.02.2021 passed by the learned Additional Sessions Judge-III-cum Special Judge SC/ST Act, Patna in connection with Special Case No. 334 of 2020 arising out of Barh P.S. Case No. 275 of 2020 registered under Sections 304/34 of the I.P.C., and Section 3(2)(V-A) of the SC/ST Act. The appellant is not a doctor qualified but allegation is that he performed surgery on the wife of the informant as a result whereof she died. Appellant is in custody since 21.01.2021.

Patna High Court CR. APP (SJ) No.2032 of 2021(3) dt.14-09-2021 2/2 Considering the nature of allegation against the appellant, I am not inclined to enlarge him on bail. Hence, prayer for bail is refused.
