This is an application for bail in connection with Rasulpur P.S. Case No. 85 of 2017 registered for the offences punishable under Sections 30 and 38 of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 119.47 litres of foreign liquor from under-constructed house of the petitioner.

Submission of learned counsel for the petitioner is that building was under construction and, as such, it cannot be said that it belongs to the petitioner and he has no criminal antecedent and is in custody for about two months.
