Petitioner apprehends arrest in a case registered for the offences punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act. Police on chase intercepted two vehicles and on search recovered 716.790 litters of foreign liquor. It also arrested some persons who disclosed that the owner of the consignment of illegal liquor was the petitioner. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner has got no criminal antecedent. Nothing incriminating has been recovered from his conscious possession. Petitioner's name has come in this case on the confessional statement of co-accused Vickey Kumar and he has no concern

Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Samastipur in Kalyanpur Police Station Case No. 208/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
