The petitioner, who is in custody, seeks bail in connection with Siwan (Muffasil) P.S. Case No. 540 of 2017 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. According to the FIR informant and petitioner were Facebook friends. Informant's mother had a paralytic attack, The petitioner called him to Siwan V. Mart to meet a good doctor. When the informant reached there, in the meantime one of petitioners friend also came there and handed over him a Katta. Both of them tried to snatch money and mobile phone of the informant and when he resisted, the petitioner shot him
Patna High Court Cr.Misc. No.31318 of 2018(2) dt.23-05-2018 2/3 below his waist, as a result he fell down. On hearing sound of firing several persons assembled there and the petitioner and his friend fled away and the informant was taken to the hospital.
Learned counsel for the petitioner submitted that petitioner has been falsely implicated in this case and he has committed no offence. The informant is a anti-social element and he received the alleged shot by someone else but only with a view to save himself he has hatched up a false and concocted story implicating the petitioner. It has further been submitted that petitioner is in custody since 15.11.2017. Petitioner has earlier moved this Court for bail vide Criminal Miscellaneous No. 13935 of 2018 which was rejected on 05.04.2018 with a liberty to renew his prayer for bail after completing six months in custody.
Considering the aforesaid facts and circumstances of the case and the observation made in order dated 05.04.2018 passed in Criminal Miscellaneous No. 13935 of 2018, the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,
