The petitioner is languishing in custody since 26.01.2019 in connection with Case No.C2-38/2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Prosecution case is that from the possession of petitioner, 18 litres of country made illicit liquor were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been roped in the present case. It is further submitted that petitioner is not having any criminal antecedent, statement to that effect has been made in paragraph

Patna High Court CR. MISC. No.15362 of 2019(2) dt.13-03-2019 2/2 no.3 of the bail application.

Learned APP has vehemently opposed the prayer for bail and submits that the recovery has been made from the possession of the petitioner.

Considering the quantity of recovery, period under custody and the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No.C2-38/2019.
